By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we can collect, store, use, process, retain and share your Personal Data as set forth in this Policy.
Remember that your use of One Hundred Feet's Services is at all times subject to our Terms of Use, which incorporates this Privacy Policy. Any capitalized terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.
This Privacy Policy covers how we treat Personal Data that we gather when you access or use our website at beans.at (the “Site”) or any Services that we may offer, including, but not limited Beans Maps, Beans Route or Beans Optimize, or any mobile application we may provide to access the Services. "Personal Data" means any information that identifies or relates to a particular individual and also includes information referred to as "personally identifiable information" or "personal information" under applicable data privacy laws, rules, or regulations.
This Privacy Policy does not cover the practices of companies we don't own or control or people we don't manage. In addition, we may receive Personal Data from third party customers that contract to use our Services.
We collect the following Personal Data from users of the Site and Services:
We collect your first and last name; email address; phone number; and physical address if you register to use the Services or create an account or download our mobile application. We may also receive this information from our customers about drivers or employees using our Services on behalf of the customer. We use this Personal Data to provide the Services to you, to verify your identity when accessing the Services, to send marketing and advertisements to you, to communicate with you and for the other purposes described in How We Use Your Personal Data below.
We may collect your bank account and routing or credit card information for purposes of processing payments by you for the Services. This information may be provided to a third-party payment processor to process such payments
We may collect name, address and signatures of your customers, and the date and time of delivery and picking for tracking and verification purposes. In such cases, you are responsible for providing all notices and obtaining all consents necessary for us to collect and process this Personal Data.
We may collect driver name and driver manifest for purposes of tracking deliveries and pickups for users of the Services.
We may collect detailed location and route information from users of the Services, which may be collected in the form of GPS signals (combined with a time-stamp) and other information sent by your mobile device through which you use 100ft Surveyor app, Beans Route and Beans Maps for Apartments . We use this information to provide our Services and for data analytics and research purposes to improve our Services, and for the other purposes described in How We Use Your Personal Data below. We do not use this information to infer characteristics about you.

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, "Cookies") to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone, or similar device when you use that device to visit our Services. Information for Internet-Based Ads (including Personal Data) may be provided to us by you, or derived from the usage patterns of particular users on the Services and/or services of third parties. Such information may be gathered through tracking users' activities across time and unaffiliated properties, including when you leave the Services. To accomplish this, we or our service providers may deliver Cookies, including a file (known as a "web beacon") from an ad network to you through the Services. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. You have the right to request that we delete the Personal Data that we have collected from you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.
You have to request inaccurate Personal Data we maintained about you, taking into account the nature of the Personal Data and the purposes of the processing of the Personal Data. You have the right to request that we correct Personal Data that we have collected from you. We may require you to provide documentation to support your request for correction.
You have the right to opt-out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising. We do not offer this opt-out as we do not sell or share your personal information under as those terms are defined in the CCPA.
You have the right to limit the use of your sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests such goods or services, to perform the services set forth in paragraphs (2), (4), (5), and (8) of subdivision (e) of Section 1798.140 of the California Civil Code. Since the only sensitive personal information we collect is your precise geolocation and we only use to the perform the Services and for other permitted purposes under the CCPA, and we do not use this information to infer characteristics about you, we are not required to provide a mechanism to exercise this right.
To exercise the rights described above, you must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data (depending on the nature of the request we may require two or more pieces of Personal Data), and (2) describes your request in sufficient detail to allow us to understand, evaluate, and respond to it. Each request that meets both of these criteria will be considered a "Valid Request." We may not respond to requests that do not meet these criteria. We will only use Personal Data provided in a Valid Request to verify you and complete your request. You do not need an account to submit a Valid Request. We will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive, or manifestly unfounded. You also may be to access, correct or delete Personal Data in your Account, although deletion of Personal Data may prevent you from using the Services if the deleted is necessary to provide the Services.
We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws (including the CCPA) with varying prices, rates, or levels of quality of the goods or services you receive related to the value of Personal Data that we receive from you.
Under California Civil Code Sections 1798.83-1798.84, California residents may obtain information regarding our disclosures, if any, of Personal Data to third parties for third-party direct marketing purposes; in order to submit such a request, please contact us at legal@beans.ai. This request may be made no more than once per calendar year.
If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at legal@beans.ai with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.
We're constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the Beans.ai website, by sending you an email, and/or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
